Welcome to Pendragon Studios LLC (“we,” “our,” or “us”). By accessing or using our website (“services”), or purchase our products, you are bound by these terms of use (“terms”).
Please read these terms carefully. If you do not agree to these Terms of Use, you should not access or use our services.
Your continued access to or use of the services signifies your confirmation that you have reviewed, comprehended, and consented to the conditions outlined in this agreement. This acceptance creates a legally binding obligation to adhere to all stipulations contained herein.
Eligibility

Account Registration
Creating an Account
You may be required to register for an account to access features of our services. When creating an account, you must provide accurate and complete details and update such information to keep it accurate and current.
Account Security
You are responsible for protecting your account and any login credentials. You must notify us if you suspect any unauthorized use of your account.
User Responsibilities
Acceptable Use
When using services, you agree not to:
♦ Violate any law, regulation, or third-party rights
♦ Use the Services for any illegal purpose
♦ Upload or transmit viruses, malware, or other malicious code
♦ Interfere with the integrity of the services
♦ Engage in activities that could harm, disable, or overburden the services
User Content
You are responsible for any content you submit, post, or display through our services. By submitting user content, you give us a worldwide, royalty-free license to use, reproduce, modify, or translate.
Intellectual Property Rights
Our Intellectual Property
All features, content, and functionality of our services, such as text, graphics, logos, icons, images, products, audio clips, downloads, software, and the compilation thereof, are owned by us, or licensors, or other providers and are protected under copyright, trademark, and other intellectual property laws.
License to Use
We give you a limited, non-exclusive, and revocable license to use our services for non-commercial use.
Third-Party Services
We do not control and assume no responsibility for the features, content, privacy policies, or practices of any third-party websites.
Disclaimers
“As Is” and “As Available”
Our services are provided on an “as is” and “as available” basis. We do not offer warranties of any kind, either express or implied.
No Guarantees
We do not guarantee that services will function uninterrupted, errors will be corrected promptly, or services will meet your requirements.
Limitation of Liability
Pendragon Studios LLC shall not bear responsibility for any indirect, consequential, incidental, special, or punitive damages under any circumstances. This includes without limitation, loss of income, profits, or data; damage to business reputation or goodwill; the cost of replacement products or services; or any harm resulting from: your utilization of or inability to utilize our services; actions, content, information, or data of third-parties that interact with our services; or any unauthorized manipulation of, access to, or alteration of your content, submissions, transmissions, or similar materials through the services.
Indemnification
By using our services, you accept responsibility to protect, defend, and exempt Pendragon Studios LLC from liability in connection with any actions, demands, proceedings, costs, charges, penalties, and expenditures (including but not limited to attorneys’ fees, legal costs, professional consultant fees, and other business expenses) that arise from: your utilization of the services; any breach or non-compliance with any provision of these terms; any allegation that content submitted by you infringes upon, misappropriates, or otherwise violates the intellectual property rights, publicity rights, confidentiality rights, or other legal rights of any third party; or any activity conducted through your account whether by you or by any other person accessing the services with your permission.
Changes to Terms
Pendragon Studios LLC retains the authority to periodically update, alter, or substitute any portion of these terms as business needs evolve. For substantial revisions, we will notify users at least 7 days before implementing the revised terms. The assessment of whether a particular modification qualifies as substantial shall be made exclusively by Pendragon Studios LLC based on internal evaluation criteria. Continued use of our services following any modification, regardless of whether notification was provided, indicates your acceptance of the updated terms.
Termination
Terminated by You
You may terminate these terms at any time by discontinuing use of our services and closing your account.
Termination by Us
Pendragon Studios LLC maintains the unrestricted authority to discontinue, revoke, or restrict your ability to access the services at any time, effective instantly, with no obligation to provide advance notification or explanation, and without incurring any financial or legal responsibility to you.
Governing Law
The agreement is governed by the laws of Michigan, United States, regardless of conflict of law principles. Every Dispute concerning the interpretation or effect of these Terms of Use and/or your use of the services must be resolved in the state or federal courts situated in the state of Michigan. You agree to the personal jurisdiction, subject matter jurisdiction, and venue of these courts.
Dispute Resolution
Informal Resolution
Before pursuing formal legal action for disagreements connected to this agreement, both parties commit to seeking an amicable solution through direct communication.
Arbitration
Should direct negotiations fail, all unresolved conflicts must proceed to binding arbitration under the American Arbitration Association in Michigan.
Severability
Should a court determine any section of this agreement to be legally deficient or impossible to enforce, that specific portion will be revised to maintain its original purpose as closely as legally permissible. The validity and enforceability of all other sections will not be affected and shall persist with their complete legal authority.
Entire Agreement
This agreement is the complete and exclusive statement of mutual comprehension between the parties concerning the services, replacing and nullifying any previous written documents, verbal arrangements, discussions, understandings, or communications addressing the same subject matter.

Commission Terms and Conditions
These terms specifically apply to commissions and any personalized piece, which also follow the Terms of Use listed above.
By submitting the commission request, you have read and agreed to these terms and conditions
♦ There are no refunds or returns
♦ You may cancel your commission at any point before the deposit is paid
♦ The artist will provide a sketch review and changes up to 3 times without extra charge before proceeding with the final piece
♦ No changes can be made to the design after approval or after the artist started the final artwork
♦ A non-refundable deposit of 50% of the total invoiced is required up front to secure the commission. If the total is $65 or under then the full amount is due before any design work is done
♦ If the buyer backs out of the commission after it’s 50% paid, the final commission piece will not be made and the amount paid will go to the artist for their time
♦ Final payment is required before the final art piece is started
♦ The artist has the right to reject a commission request for any reason before an invoice is sent and payment is made from the buyer
♦ The artist retains the right to showcase commissioned artwork in their professional or promotional materials
♦ The artist retains the right to maintain legal copyright and ownership of any designs created in this process
♦ The buyer is allowed to use the commissioned piece for personal use only, unless agreed upon otherwise for commercially
